The Minority in Parliament has raised concerns over what they describe as a violation of Section 4(1) of the Presidential Office Act by President John Mahama. According to the Minority, the President announced appointments to his office on January 21, 2025, even though the Council of State has not yet been constituted.
They argue that the President failed to specify that the appointments were provisional and subject to confirmation once the Council of State is formed, as the law stipulates.
Patrick Boamah, the Member of Parliament for Okaikwei Central, spoke on behalf of the Minority, emphasizing the need for compliance with legal procedures.
“Section 4(1) clearly states that the president shall make such appointments in consultation with the Council of State. In our view, the President has contravened the provisions of Act 463,” he noted.
Boamah called on the President to reconsider his actions and withdraw the appointment letters, urging that they be reissued in accordance with the legal framework. “At the very least, the letter should have included a clause indicating that these appointments are provisional, pending the formation of the Council of State, and will be regularized as required by law,” he added.
